By using this website or placing an order, you agree to these Terms. If you do not agree to these Terms, please do not use the website or place an order.
These Terms apply together with the following policies, where applicable:
Nothing in these Terms limits any mandatory statutory rights available to consumers under applicable law.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications and other information displayed on our website are accurate and up to date.
Due to differences in monitors, displays, lighting and manufacturing processes, colours and visual appearance may differ slightly from the images shown on the website.
Our products may be manufactured using 3D-printing processes. Minor variations in layer lines, surface texture, colour, small dimensional differences or other characteristics inherent to the manufacturing process do not necessarily constitute a defect where the product remains functional and conforms to the agreed specifications.
Product information may be updated from time to time. Changes to product information will not affect an order that has already been accepted unless required by law or agreed with you.
We may discontinue products or modify product designs where permitted by law. Such changes will not affect contracts that have already been concluded unless otherwise required by applicable law.
3. Orders and Conclusion of Contract
The presentation of products on our website does not constitute a legally binding offer to conclude a sales contract.
By placing an order through our online checkout, you submit a legally binding offer to purchase the products in your order.
After submitting an order, you will normally receive an electronic confirmation acknowledging receipt of your order. This confirmation of receipt does not necessarily constitute acceptance of your offer.
A sales contract is concluded when we expressly accept your order or when we dispatch the ordered goods, whichever occurs first, unless otherwise stated during the ordering process.
If we cannot accept your order, for example because a product is unavailable or there is an obvious technical or pricing error, we will inform you and refund any payment already made.
You are responsible for ensuring that the information provided during checkout, including your name, delivery address, billing information and contact details, is accurate.
Mandatory statutory consumer rights, including statutory withdrawal rights, remain unaffected.
4. Cancellation, Withdrawal and Returns
You may request cancellation of an order within 24 hours after placing the order, provided the order has not already been processed or shipped.
This voluntary cancellation option does not replace or restrict any statutory right of withdrawal.
Consumers within the European Union generally have a statutory 14-day right of withdrawal for distance contracts, subject to the statutory exceptions.
Further information about cancellation, withdrawal, returns, return shipping costs, refunds and applicable exceptions is provided in our separate Return Policy.
Where a statutory right of withdrawal applies, nothing in these Terms or our return policies restricts that right.
Certain products may be excluded from the statutory right of withdrawal where a statutory exception applies, including certain goods made according to the consumer's individual specifications or clearly personalised goods. Made-to-order production alone does not automatically exclude the statutory right of withdrawal.
5. Prices and Payment
All prices displayed to consumers within the European Union include applicable VAT unless expressly stated otherwise.
Shipping costs and any other additional charges will be displayed separately before you submit your order.
For orders delivered outside the European Union, additional import duties, customs charges, import VAT or other local taxes and fees may apply. Unless otherwise expressly stated at checkout, such charges are the responsibility of the recipient.
The price applicable to your order is the price displayed at the time you submit your order, subject to obvious pricing or technical errors.
We accept the payment methods displayed during the checkout process.
You are responsible for providing accurate billing and payment information and for ensuring that your selected payment method can be used to complete the transaction.
6. Shipping and Delivery
We ship to the destinations made available during the checkout process.
Estimated delivery times are provided for guidance and may vary depending on the destination, production time, shipping method, carrier, customs procedures and other circumstances.
Where products are made to order, the applicable production or dispatch timeframe will be stated on the relevant product page or during checkout where applicable.
We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs procedures, natural disasters, strikes, governmental restrictions or similar events.
This does not affect any mandatory statutory rights you may have in relation to delayed delivery or non-delivery.
For consumer sales, statutory rules regarding the transfer of risk apply. In particular, the risk of accidental loss or accidental deterioration generally does not pass to a consumer merely because the goods have been handed over to a carrier selected by us. Applicable statutory exceptions remain unaffected.
7. Statutory Defect Rights
We are responsible for statutory defect liability (Gewährleistung) in accordance with applicable law.
If goods are defective or do not conform to the contract, consumers may have statutory rights including, depending on the circumstances, repair, replacement, reduction of the purchase price or withdrawal from the contract.
For consumer sales within the European Union, statutory defect rights generally apply for two years from delivery, subject to applicable legal provisions and exceptions.
These statutory rights are separate from any voluntary manufacturer's warranty.
Fused Visions does not provide an additional voluntary manufacturer's warranty unless a specific product or offer expressly states otherwise.
Further information is provided in our separate Warranty Policy.
8. Intellectual Property
All content made available through the Fused Visions website, including but not limited to:
- logos and trademarks;
- product names;
- product designs;
- photographs;
- graphics;
- illustrations;
- videos;
- written content;
- website layouts; and
- other original materials
is owned by Fused Visions, its licensors or other respective rights holders and is protected by applicable intellectual property laws.
You may use the website and its content only for lawful personal or purchasing-related purposes.
Unless permitted by applicable law or expressly authorised by us, you may not reproduce, distribute, modify, publicly display, commercially exploit, sell, license, create derivative works from or otherwise use our protected content without prior written permission.
Nothing on the website grants you ownership of or any broader licence to our intellectual property.
9. Customer Reviews and Other User Content
If you voluntarily submit reviews, photographs, comments, suggestions or other content to Fused Visions, you retain ownership of your content.
By submitting such content, you grant Fused Visions a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and distribute the submitted content for purposes connected with operating, promoting and improving Fused Visions and its products.
This licence does not transfer ownership of your content to Fused Visions.
You represent that:
- you have the necessary rights to submit the content;
- the content does not unlawfully infringe third-party rights;
- the content does not contain unlawful or misleading material; and
- you have obtained any necessary permissions from persons depicted in photographs or other submitted material.
We may remove or refuse to publish content that is unlawful, misleading, fraudulent, abusive, discriminatory, defamatory or infringing, or that otherwise violates applicable law.
We do not guarantee that customer reviews or other user-generated content represent the views of Fused Visions.
10. Third-Party Services and Links
Our website may use third-party services, applications and technologies, including payment providers, shipping providers, analytics services, Shopify and other service providers.
Third-party services may operate under their own terms and privacy policies.
We are not responsible for the independent operation, availability, content or policies of third-party services to the extent permitted by applicable law.
Our website may contain links to third-party websites. Such links are provided for convenience and do not necessarily constitute an endorsement of the linked website, product or service.
11. Shopify and Payment Infrastructure
Our online store is hosted and technically powered by Shopify.
Shopify provides the technical infrastructure used to operate the online store and may provide services relating to hosting, checkout, payment processing, security and other technical functions.
The purchase contract for products sold through our store is concluded directly between you and Fused Visions.
Shopify is not the seller of the products offered by Fused Visions.
Information about the processing of personal data in connection with Shopify and other service providers is provided in our Privacy Policy.
12. Permitted and Prohibited Use
You may use our website only for lawful purposes and in accordance with these Terms.
You must not use the website to:
- violate applicable law;
- infringe intellectual property or other third-party rights;
- gain unauthorised access to systems or accounts;
- introduce malware, viruses or other harmful code;
- interfere with the operation or security of the website;
- engage in fraudulent or deceptive activity;
- impersonate another person or provide deliberately false information;
- attempt to circumvent security or access restrictions;
- conduct unauthorised automated scraping or data collection; or
- otherwise misuse the website or our services.
Where legally permitted, we may restrict or terminate access to the website where necessary because of unlawful, fraudulent, abusive or security-threatening activity.
Mandatory consumer rights remain unaffected.
13. Technical, Typographical and Pricing Errors
We make reasonable efforts to ensure that information on the website is accurate.
However, occasional technical, typographical, photographic or pricing errors may occur.
We reserve the right to correct obvious errors.
If an obvious error affects an order that has already been placed, we will inform you as soon as reasonably possible.
Where permitted by applicable law, if an obvious error means that the contractual price or product description was materially incorrect, we may cancel the affected order and refund any payment already made.
This provision does not limit any mandatory statutory rights.
14. Liability
Our liability is governed by applicable law.
We are fully liable where legally required, including for:
- intentional misconduct;
- gross negligence;
- injury to life, body or health;
- liability under mandatory product liability legislation; and
- other cases where liability cannot legally be excluded or limited.
In cases of ordinary negligence, liability is limited, where legally permissible, to foreseeable and typical damage resulting from a breach of an essential contractual obligation.
An essential contractual obligation is an obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer can ordinarily rely.
The above limitations do not apply where liability is mandatory or where applicable law prohibits such limitations.
Nothing in these Terms excludes or limits statutory consumer rights.
15. Data Protection
We process personal data in accordance with applicable data protection legislation, including the EU General Data Protection Regulation (GDPR) where applicable.
Personal data may be processed by Fused Visions and by service providers involved in operating our online store, processing payments, fulfilling orders, delivering products, providing customer support, preventing fraud or performing other necessary business functions.
Further information about the categories of data processed, purposes, legal bases, retention periods and your rights is provided in our separate Privacy Policy.
16. Consumer Dispute Resolution
Fused Visions is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless required by applicable law or unless we expressly agree to participate in a particular case.
Where legally applicable, information required under the German Consumer Dispute Resolution Act (VSBG) will be provided.
If a consumer dispute cannot be resolved directly between the parties, statutory information obligations that arise after the dispute may apply.
Where applicable law requires us to provide information about a competent consumer arbitration board, we will provide the required information.
17. Governing Law and Consumer Protection
German law applies to these Terms and the contractual relationship between you and Fused Visions, subject to mandatory consumer protection provisions that apply in the country in which you have your habitual residence.
If you are a consumer, the choice of German law does not deprive you of protections that cannot be contractually excluded under the mandatory laws applicable to you.
Nothing in these Terms affects mandatory jurisdiction rules or other mandatory consumer protections applicable to cross-border consumer contracts.
18. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force to the extent permitted by law.
The invalid or unenforceable provision will be replaced or interpreted, where legally possible, in a manner that most closely reflects its original lawful purpose.
This provision does not constitute an agreement to amend mandatory statutory consumer protections.
19. Changes to These Terms
We may update these Terms from time to time where necessary to reflect changes to our products, services, business operations or applicable legal requirements.
The version of these Terms applicable at the time the relevant contract was concluded will generally apply to that contract, unless a later change is required by law or otherwise validly agreed with you.
The current version of these Terms will be made available on our website.
Changes will not retroactively remove or restrict mandatory statutory rights.
20. Electronic Communications
When you use our website, place an order or communicate with us electronically, you agree that we may communicate with you electronically where permitted by law.
This may include communications relating to:
- order confirmations;
- payment;
- shipping;
- delivery;
- returns;
- refunds;
- customer service;
- product-related matters; and
- other information necessary for the performance of a contract.
Electronic communications satisfy legal requirements for written communication where applicable law permits electronic form.
Mandatory information that must be provided in a specific form remains subject to the applicable statutory requirements.
21. Events Beyond Our Reasonable Control
We are not responsible for failure or delay in performing contractual obligations where such failure or delay results from circumstances beyond our reasonable control.
Such circumstances may include, where applicable:
- natural disasters;
- severe weather;
- fire;
- war;
- governmental measures;
- pandemics or similar widespread events;
- strikes or industrial disputes;
- significant transport disruptions;
- major carrier failures;
- widespread technical or telecommunications failures;
- interruptions affecting essential suppliers; or
- other events that could not reasonably have been prevented or overcome.
Where such circumstances occur, we will take reasonable steps to minimise their impact and resume performance as soon as reasonably possible.
This provision does not exclude or restrict any mandatory statutory rights.
22. No Waiver
If we do not immediately enforce a right or provision under these Terms, this does not mean that we waive that right or provision.
A waiver of a particular right or provision is effective only where legally valid and expressly made.
Any waiver applies only to the specific circumstance for which it was given and does not constitute a general waiver of future rights.
23. Entire Agreement and Contract Documents
These Terms, together with the documents expressly incorporated into them, form the contractual framework governing your use of the Fused Visions website and purchases made through the store.
These documents may include, where applicable:
- the product information displayed at the time of purchase;
- your order details;
- the Return Policy;
- the Shipping Policy;
- the Warranty Policy;
- the Privacy Policy; and
- the Imprint.
Where there is a conflict between these Terms and mandatory statutory law, mandatory statutory law takes precedence.
Where there is a conflict between these Terms and an individually agreed contractual provision, the individually agreed provision takes precedence to the extent legally permissible.
